These terms of use (the «Terms») apply to the use of Aquaplan AS's services: the training app AquaPlan for Swimming (Norwegian and English versions) and the website aquaplan.no (the «Service»).
By creating an account, starting a trial or paying for a subscription, you accept these Terms. If you represent a sports club or organisation, you confirm that you are authorised to enter into this agreement on its behalf.
We may update the Terms. Significant changes are announced by email at least 30 days before they take effect. If you continue to use the Service after that, you are deemed to accept the updated Terms.
This is a translation of the Norwegian terms (brukervilkår). If the two versions differ, the Norwegian version applies.
To use the Service you must create a user account with a valid email address. You are responsible for keeping your login details secret and for all activity on your account.
New coaches get a free 30-day trial. No payment card is needed to start. After the trial you must choose a subscription to keep using the coach features.

Prices are in euro (EUR) excluding VAT, which is added where required. You choose monthly or yearly billing; yearly billing equals two months free. Payments are handled by Stripe. Aquaplan AS does not store payment card details.
The subscription renews automatically at the end of each billing period (month or year) until it is cancelled. You can cancel at any time under «Manage subscription» in the app, or by contacting us at post@aquaplan.no.
When you cancel, you keep access until the end of the period you have paid for. No refunds are given for the remaining time of a paid period, unless otherwise required by law or we have made a significant error.
You must use the Service in accordance with applicable law and these Terms. The following is not allowed:
Breaches may lead to the account being closed or deleted without a refund.
Training plans, log entries and other content you create in the Service belong to you. You give Aquaplan AS a limited, non-exclusive right to store and display the content, solely to provide the Service.
The software, design, texts and all other intellectual property in the Service belong to Aquaplan AS. You get a personal, non-transferable right to use the Service under these Terms, but no right to copy, modify, distribute or create derivative works from it.
The Service can be connected to services from other providers, such as Polar Flow. Such connections are optional. The other provider's own terms apply to their service.
We are not responsible for the availability of such services or for the accuracy of data from them. You can disconnect at any time in the app; the imported data is then deleted (see the privacy policy § 7).
We work for high uptime and stable operation, but cannot guarantee that the Service is always available. Planned maintenance is announced in reasonable time. Unplanned outages may occur.
Aquaplan AS is not liable for losses or inconvenience caused by temporary outages, as long as we act with reasonable care to restore the Service.
The Service is provided «as is». Aquaplan AS gives no warranties beyond what follows from mandatory law, for example that the Service is fit for a particular purpose or free of errors.
Training plans, heart rate data and analyses in the Service are training aids and do not replace medical advice.
Aquaplan AS is not liable for indirect losses, consequential losses, lost profits or loss of data, unless the loss is caused by gross negligence or wilful misconduct on our part. Our total liability in any twelve-month period is limited to the amount you have paid for the Service in that period.
How we process personal data is described in the privacy policy, which forms part of these Terms.
You can ask us to delete your account at any time by contacting us at post@aquaplan.no. Your account and data are then deleted within 30 days. If you want a copy of your data first, you can ask for it at the same time.
Aquaplan AS may close or delete your account in the event of a significant breach of these Terms, with prior notice where practically possible.
These Terms are governed by Norwegian law. Disagreements about the Service or the Terms should first be resolved in dialogue with us.
If you are a consumer, you may also have rights under the mandatory consumer protection rules of the country where you live, and you can contact your national consumer authority. In Norway, the Consumer Council (forbrukerradet.no) offers mediation. Disputes that are not resolved may be brought before the ordinary courts. For consumers, the consumer's ordinary place of jurisdiction applies; otherwise the place of jurisdiction is where Aquaplan AS has its business office.
